     มาตรา ๑๖๑ ถ้ากลฉ้อฉลเป็นแต่เพียงเหตุจูงใจให้คู่กรณีฝ่ายหนึ่งยอมรับข้อกำหนดอันหนักยิ่งกว่าที่คู่กรณีฝ่ายนั้นจะยอมรับโดยปกติ คู่กรณีฝ่ายนั้นจะบอกล้างการนั้นหาได้ไม่ แต่ชอบที่จะเรียกเอาค่าสินไหมทดแทนเพื่อความเสียหายอันเกิดจากกลฉ้อฉลนั้นได้

     Section 161 If the fraud is merely a cause by which a party is moved to accept a requirement which is heavier than that which the party would normally accept, the party cannot avoid his act but is entitled to claim compensation for the damage arising from such fraud.

     มาตรา ๑๖๓ ถ้าคู่กรณีต่างได้กระทำการโดยกลฉ้อฉลด้วยกันทั้งสองฝ่าย ฝ่ายหนึ่งฝ่ายใดจะกล่าวอ้างกลฉ้อฉลของอีกฝ่ายหนึ่งเพื่อบอกล้างการนั้นหรือเรียกค่าสินไหมทดแทนมิได้
