Playing better with rhs ToC

If, 1a., a user has selected rhs ToC OR, 1b., a page has a rhs ToC template AND, 2., a template using this does not begin the line (this specification not fully tested), then there can be a lot of whitespace generated: The box begins below the bottom of the ToC. Can this be fixed? It is not the highest of priorities, but would improve the consistency of entry appearance and the amount of content visible at the top of a page with RhS ToC.
