  Es entspricht weiter ständiger Rechtsprechung des BGH, dass § 548 BGB auch Ansprüche des Vermieters wegen Veränderungen und Verschlechterungen der vermieteten Sache erfaßt, die nicht auf Mietvertrag, sondern auf unerlaubte Handlung gem. § 823 ff. BGB gestützt sind. Würden konkurrierende Ansprüche nicht ebenfalls von § 548 BGB erfaßt, würde dessen Anwendungsbereich erheblich eingeschränkt. So findet § 548 BGB auch Anwendung auf Ansprüche, die sich auf demselben Sachverhalt begründen, jedoch aus Tatbeständen außerhalb des Mietrechts hergeleitet sind.
  It is also established case law of the BGH that § 548 BGB also covers claims of the landlord for alterations to and deterioration of the rented property that are not based on the rental agreement but on tort pursuant to § 823 et seq. BGB. If competing claims were not also covered by § 548 BGB, its scope of application would be considerably restricted. § 548 BGB also applies to claims that are based on the same facts but are derived from elements outside of tenancy law.
