- a) Eine Ausgleichsklausel, nach der mit der im Vergleich getroffenen Regelung – wie hier – „sämtliche wechselseitigen Ansprüche zwischen den Parteien erledigt sind”, erfaßt ihrem Wortlaut nach auch etwaige unbekannte Ansprüche, ohne daß es noch eines klarstellenden Zusatzes bedürfte. Jeder forensisch erfahrene Anwalt weiß, daß eine so formulierte generelle Ausgleichsklausel typischerweise ein wechselseitiges negatives Schuldanerkenntnis i. S. d. § 397 Abs. 2 BGB zum Inhalt hat und bestimmungsgemäß jegliche weitergehenden Ansprüche zwischen den Parteien ausschließt.
